This Statement applies to all learner users of DriveStruct and, where relevant, to their parents, guardians, carers, or legal representatives. It applies in addition to any DriveStruct Terms of Use, Privacy Policy, Safeguarding Policy, consent forms, or related notices published from time to time.
Where a learner is under the age of 18, DriveStruct may require the involvement, confirmation, or consent of a parent or legal guardian before access is granted to certain services, communications, or platform features. DriveStruct reserves the right to request reasonable evidence of identity, age, parental responsibility, or authority to act on behalf of the learner where necessary for service administration, safeguarding, compliance, or dispute resolution purposes.
Parents and guardians must ensure that any information submitted to DriveStruct on behalf of a learner is accurate, complete, and kept up to date. They must also take reasonable steps to supervise the learner’s use of the platform, maintain the security of account credentials, and ensure that the learner uses DriveStruct lawfully, responsibly, and in accordance with all applicable DriveStruct terms, policies, and guidance.
DriveStruct may contact parents and guardians where reasonably necessary to administer the platform, support the learner\'s use of the service, respond to technical or account issues, investigate complaints, address conduct concerns, or manage safeguarding matters. Such communication may be limited, delayed, or withheld where DriveStruct considers that the learner\'s rights, confidentiality, age, capacity, or applicable legal requirements justify a different approach.
DriveStruct takes safeguarding concerns seriously and may take appropriate action where a concern is raised about learner safety, misconduct, inappropriate behaviour, misuse of the platform, or suspected unlawful activity. Such action may include reviewing relevant information, restricting access, suspending services, making internal referrals, or reporting concerns to appropriate authorities where disclosure is permitted or required by law.
DriveStruct may collect and process personal data relating to parents and guardians where this is necessary for account administration, safeguarding, service delivery, legal compliance, record-keeping, or the protection of the vital interests of a learner or another individual. Personal data must be handled in accordance with applicable data protection law, including the UK GDPR and the Data Protection Act 2018, and further details should be provided in the DriveStruct Privacy Policy or Privacy Notice.
Any access provided to parents or guardians in relation to learner information, progress, account activity, or related records will be subject to applicable law, safeguarding considerations, confidentiality requirements, and the learner’s own legal rights. DriveStruct reserves the right to limit or refuse disclosure where it considers that disclosure would be inappropriate, unlawful, or inconsistent with the learner’s rights or welfare.
Where a parent, guardian, or learner breaches any applicable DriveStruct term, policy, or requirement, DriveStruct may take such action as it reasonably considers necessary to protect the platform, its users, and its legal position. This may include warnings, account restrictions, suspension, termination of access, refusal of future access, or escalation to relevant authorities or advisers.
DriveStruct reserves the right to amend this Statement at any time where reasonably necessary to reflect changes in law, regulation, safeguarding practice, operational requirements, or platform functionality. Any updated version may be published through the DriveStruct website or otherwise made available to users and parents or guardians by appropriate means.
